Terms of Service

These Terms of Service ("Terms") set out the basis on which Must Medical Equipment ("Must Medical", "we", "us") provides this website, our products and our services to you. Please read them carefully — they include limitations on our liability and important terms about orders, rentals and returns.

By using this website or placing an order, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the site.

2. Using this site

You must be the age of majority in British Columbia to place an order. You agree to provide accurate, current and complete information when ordering, and to keep your account credentials secure. You are responsible for activity on your account.

You may not use this site unlawfully, attempt to interfere with its security, scrape or extract its content in bulk, or use it to transmit malicious code.

3. Products and descriptions

We make every effort to describe our products accurately, but colours and appearance may differ on your screen, and specifications may change without notice as manufacturers revise their products. Where a product page lists a manufacturer's specifications, indications or claims, those are the manufacturer's and are reproduced for identification.

We may discontinue any product, and may limit quantities to any person, region or order.

4. Medical equipment is not medical advice

Nothing on this site is medical advice, and we do not diagnose, prescribe or provide clinical assessment. Information about braces, compression, mobility and home care equipment is general and does not replace guidance from your physician, physiotherapist, occupational therapist or other qualified professional.

Where a clinician has specified a product, model or setting, follow their specification. If you ask us to supply something specific, we supply what you have asked for; we are not responsible for the clinical suitability of that choice. Some products we sell are intended to be fitted or adjusted by a qualified professional.

Always follow the manufacturer's instructions, weight limits and maintenance requirements.

5. Orders

Placing an order is an offer to purchase. We may accept or decline any order at our discretion, and an order is not accepted until we confirm it. If we decline, change or cancel an order, we will contact you using the details you provided.

Prices are in Canadian dollars and exclude taxes, delivery, installation and any applicable charges unless stated. Prices, discounts and promotions may change without notice; the price that applies is the one shown in your order confirmation.

Occasionally a listing may contain an error in price, description or availability. We may correct it and cancel affected orders, including after an order has been submitted, and will refund you in full if we do.

6. Special and custom orders

Products built or ordered to your specification — custom wheelchairs and seating, special sizes and configurations, and brands we order in rather than stock — are final sale unless they arrive damaged or defective. Lead times are estimates given in good faith and depend on the manufacturer. We will tell you before you order if an item is a special order.

7. Delivery and installation

Delivery terms are set out in our Shipping Policy. Delivery and installation times are estimates and are not guaranteed. We are not liable for delays caused by carriers, manufacturers, weather or other events outside our control.

Where we deliver into a home or facility, you are responsible for ensuring safe and lawful access and that the equipment will fit the space and any doorways or route required. If you are unsure, ask us before ordering — measurement advice is free.

8. Returns and refunds

Returns are governed by our Refund Policy, which forms part of these Terms.

9. Rentals

Rental equipment remains our property throughout the rental. Rental periods, rates, deposits, delivery, collection and early-return terms are set out in your rental agreement, which governs the rental and takes precedence over these Terms where they differ.

You are responsible for the equipment while it is in your possession, including loss and damage beyond normal wear, and for using it as instructed. Do not modify rental equipment or allow it to be repaired by anyone other than us.

10. Payment plans

Where we offer an in-house payment plan, the terms of that plan — deposit, instalment amounts, schedule and any conditions — are set out in the agreement you sign at the time of purchase. That agreement governs the plan. Figures shown by any payment calculator on this site are estimates for illustration only and are not an offer of credit.

11. Warranty

Products carry the manufacturer's warranty, which varies by manufacturer and product. We will assist with warranty claims. Beyond any manufacturer warranty and your rights under applicable law, products are provided without further warranty from us.

12. Intellectual property

The content of this site — text, images, graphics, product descriptions, layout and design — belongs to Must Medical or its suppliers and is protected by copyright and other intellectual property laws. You may use the site for your own personal, non-commercial purposes. You may not copy, republish, distribute or create derivative works from it without our written consent.

Manufacturer names, brand names and logos appearing on this site are the property of their respective owners and are used to identify the products we supply.

13. Third-party links and tools

This site may link to or embed services operated by third parties, including manufacturers, suppliers, booking and payment tools. We do not control them and are not responsible for their content, policies or practices. Third-party tools are provided as-is; review their terms before using them.

14. Reviews and submissions

If you submit a review, photograph, suggestion or other content, you grant us a non-exclusive, royalty-free licence to use, reproduce and display it in connection with our business. You confirm the content is yours to give and is not unlawful, misleading or infringing. We may edit or remove submissions at our discretion and are not obliged to publish anything.

15. Relationship with Shopify

This store is powered by Shopify, which enables us to provide these services to you. Any purchase you make is made directly with Must Medical Equipment. Shopify is not responsible for any aspect of the sale, including any injury, damage or loss resulting from products purchased, and you release Shopify and its affiliates from claims arising from your transactions with us.

16. Automated agents

Software agents accessing this site must identify themselves as such in their requests, must not disguise automated activity as human, and must not circumvent measures we use to control automated access.

17. Limitation of liability

To the fullest extent permitted by law, Must Medical is not liable for indirect, incidental, consequential, punitive or special damages, including lost profits or lost data, arising from your use of this site or of any product purchased or rented through it.

Nothing in these Terms excludes or limits liability that cannot be excluded by law, including liability for death or personal injury caused by negligence, or any rights you have under the Business Practices and Consumer Protection Act (British Columbia) or the Sale of Goods Act (British Columbia).

18. Indemnity

You agree to indemnify Must Medical against claims, losses and reasonable costs arising from your breach of these Terms, your violation of law or the rights of others, or your misuse of products supplied by us.

19. Governing law

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada that apply in it. You and Must Medical submit to the exclusive jurisdiction of the courts of British Columbia.

20. General

If any provision of these Terms is found unenforceable, the remainder continues to apply. Our failure to enforce a provision is not a waiver of it. These Terms, together with the policies referred to in them, form the entire agreement between us regarding your use of this site.

You may not assign your rights under these Terms without our consent. We may assign ours.

21. Changes

We may update these Terms from time to time by posting a revised version on this page. Continued use of the site after changes are posted constitutes acceptance of them.
